Ashley Gillihan, Partner, Alston & Bird, LLP

Ashley Gillihan is a partner in the Firm's Employee Benefits and Executive Compensation Group. He is also a secondary member of the firm's ERISA Litigation Group. Mr. Gillihan's legal practice focuses exclusively on assisting clients with various health and welfare benefit plan issues related to the following:
  • Implementation and administration of consumer driven health care arrangements such as Health Reimbursement Arrangements and Health Savings Accounts
  • ERISA's reporting and disclosure rules 
  • ERISA's fiduciary requirements 
  • ERISA's claims procedure rules and regulations
  • COBRA Administration 
  • HIPAA Portability and Discrimination
  • HIPAA Privacy, Security, and Administrative Simplification
  • Tax issues associated with health and welfare benefit plans, including, but not limited to, health plans, disability plans, life insurance plans, and various other fringe benefit plans (e.g. Code Section 125 cafeteria plans, flexible spending accounts, transportation reimbursement arrangements and educational assistance plans) and VEBAs
  • Various group health plan mandates related to QMCSOs, Mental Health Parity Act, the Newborn and Mother's Health Protection Act, and the Women's Health and Cancer Rights Act

Mr. Gillihan represents corporate plan sponsors, insurers and third party benefit plan administrators. 

Mr. Gillihan lectures frequently and has published numerous articles on health and welfare benefit plan related topics. He is a faculty member for MCOL, a managed health care on-line organization; and the Institute of Applied Management and Law (IAML) and he is a a member of the Advisory Board of Editors of the Benefits Compensation Law Alert and the Employer's Council on Flexible Compensation Technical Advisory Council. 


John R. Hickman, Partner, Alston & Bird, LLP

John Hickman is head of the Health & Welfare Benefits sub-group of the firm's Employee Benefits and Executive Compensation Group. He is also a member of the firm's Privacy and Data Management Task Force. Mr. Hickman is also an adjunct professor of law at Emory University School of Law. Mr. Hickman concentrates his practice primarily upon health and welfare benefit plan matters and the tax, ERISA, HIPAA, and other compliance issues that arise in connection with such arrangements. 

Mr. Hickman represents employers, insurers and third-party administrators, assisting them with plan design and limiting their potential exposure to benefit claims. Mr. Hickman has been called upon by benefits and trade associations to testify before the IRS and DOL on issues affecting health and welfare benefit plans including HIPAA, cafeteria plan regulations, DOL claims procedures, and the recent DHHS health care privacy regulations. 

John has lectured widely and published articles on HIPAA, ERISA litigation, and cafeteria and health plan issues. He is co-author of the Cafeteria Plans Manual, HIPAA Portability and Privacy, and Consumer-Driven Health Care & Fringe Benefits (published by the Employee Benefits Institute of America). He is also on the editorial advisory board of the Benefits & Compensation Law Alert, is a past member of the editorial advisory board of the Benefits Law Journal, is Chair of the Technical Advisory Committee of the Employers Council on Flexible Compensation (ECFC), and is on the Publications Committee of the Self-Insurance Institute of America. Mr. Hickman is an Adjunct Professor at Emory University School of Law.
